With provisions added to Capital Markets Law No. 6362 in 2024, crypto asset service providers became subject to the authorisation and supervision of the Capital Markets Board. Platform operation, custody services and trading intermediation constitute different scopes of authorisation. Capital adequacy, information systems security, segregation of customer assets and AML compliance are central to the application.
Requirements
- Incorporation as a joint stock company with shares registered in name
- Minimum equity and capital adequacy conditions set by the Board
- Information systems and cyber security audit reports
- A custody structure segregating customer crypto assets from company assets
- AML compliance programme, compliance officer and transaction monitoring systems
- Fulfilment of the conditions required of managers and qualified shareholders
